U.S. law protects persons who are able to prove that they have a well-founded fear of violence, torture or other persecution in their country of origin on account of their political opinion, race, religion, nationality, or membership in what is known as a “particular social group,” which is a legal term to describe a group that is recognized in the country of origin. The group’s members must have this in common that they either cannot change or should not have to change.
U.S. law, through the Convention Against Torture, also protects persons fleeing torture at the hands of their country of origin’s government, even in cases where the feared torture is not on account of one of the five protected grounds mentioned above.
